MINIGP NORTHEAST ASIA 시리즈 책임 면제 및 동의서
MINIGP NORTHEAST ASIA SERIES LIABILITY WAIVER AND RELEASE AGREEMENT
본 책임 면제 및 동의서(이하 "동의서")는 MiniGP Northeast Asia 시리즈(이하 "대회")에 참가하는 참가자 및/또는 참가자의 법적 보호자(이하 "참가자")와 Korea Mobility Group(이하 "주최측") 간에 체결됩니다.
This Liability Waiver and Release Agreement ("Agreement") is entered into by and between the undersigned participant and/or the participant’s legal guardian ("Participant") and Korea Mobility Group ("Organizer") in relation to participation in the MiniGP Northeast Asia Series ("Event").
1. 위험 인지
ACKNOWLEDGEMENT OF RISK
참가자는 모터사이클 경주가 중대한 부상, 장애, 사망 및/또는 재산 피해의 위험이 내재된 본질적으로 위험한 활동임을 인지하고 이에 동의합니다. 참가자는 자발적으로 대회 참가로 인해 발생할 수 있는 모든 위험을 전적으로 감수합니다.
Participant acknowledges and agrees that motorcycle racing is an inherently dangerous activity involving the risk of serious injury, disability, death, and/or property damage. Participant voluntarily assumes full responsibility for any risks arising from participation in the Event.
2. 책임 면제
RELEASE OF LIABILITY
참가자는 대회에 참가할 수 있도록 허락받는 대가로, 본인 및 본인의 상속인, 법적 대리인, 관리자, 양수인 등을 대표하여, 주최측, FIM, FIM Asia, Dorna Sports, Ohvale, 후원사, 관계사, 임직원, 자원봉사자 및 대리인(이하 "면책 당사자")을 대상으로 한 모든 법적 책임, 손해, 손실 또는 부상(사망 포함)에 대한 모든 청구로부터 면책 당사자를 면제하고 청구하지 않기로 약속합니다.
In consideration for being allowed to participate in the Event, Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and covenants not to sue the Organizer, FIM, FIM Asia, Dorna Sports, Ohvale, sponsors, affiliates, officers, employees, volunteers, and agents ("Released Parties") from any and all liability for any claims, damages, losses, or injuries (including death) that may be sustained as a result of participation in the Event.
3. 면책 당사자에 대한 배상
INDEMNIFICATION
참가자는 대회 참가와 관련하여 발생하는 모든 청구, 요구, 소송, 손해배상 청구로부터 면책 당사자를 방어하고 손해가 없도록 배상할 것을 동의합니다. 이는 면책 당사자의 과실로 인해 발생한 청구도 포함합니다.
Participant agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, actions, or causes of action arising out of or in connection with participation in the Event, including claims arising from the negligence of the Released Parties.
4. 의료 조치 동의
MEDICAL AUTHORIZATION
참가자는 부상 또는 의료 응급 상황 발생 시 주최측 및 그 대리인이 참가자를 대신하여 적절한 의료 조치를 취할 수 있도록 허락합니다. 이에 대한 모든 의료비는 참가자의 책임임을 인정합니다.
Participant authorizes the Organizer and its representatives to seek medical treatment on Participant’s behalf in the event of an injury or medical emergency. Participant agrees to be financially responsible for any medical treatment provided.
5. 보험
INSURANCE
참가자는 대회 참가와 관련된 적절한 개인 의료, 사고, 책임 보험에 가입할 책임이 본인에게 있음을 인정합니다.
Participant acknowledges that it is their responsibility to obtain adequate personal medical, accident, and liability insurance coverage for participation in the Event.
6. 사진 및 미디어 사용 동의
PHOTOGRAPHY AND MEDIA RELEASE
참가자는 대회 기간 동안 촬영된 사진, 영상, 초상권을 주최측 및 그 지명인이 홍보, 상업적 또는 정보 제공 목적으로 별도의 보상 없이 사용할 수 있도록 허락합니다.
Participant grants the Organizer and its designees the right to use any photographs, video recordings, or likenesses of the Participant taken during the Event for promotional, commercial, or informational purposes without further compensation.
7. 준거법 및 관할권
GOVERNING LAW AND JURISDICTION
본 동의서는 대한민국 법률에 따라 해석 및 집행되며, 본 동의서와 관련하여 발생하는 모든 분쟁은 대한민국 법원의 관할에 따릅니다.
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising under this Agreement shall be resolved in the courts of the Republic of Korea.
8. 일부 무효의 효력 또는 분리의 가능성
SEVERABILITY
본 동의서의 일부 조항이 무효 또는 집행 불가능하다고 판단될 경우, 나머지 조항은 계속 유효합니다.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9. 전체 합의
ENTIRE AGREEMENT
본 동의서는 본 건과 관련하여 당사자 간의 완전한 합의를 구성하며, 이전의 모든 논의나 합의를 대체합니다.
This Agreement constitutes the entire understanding between the parties regarding the subject matter herein and supersedes all prior discussions or agreements.
